Terms of Use

1. Who provides Sundae

Sundae (the “app”) and this website are provided by:

2. Acceptance of these terms

These Terms of Use form a binding agreement between you and us for your use of Sundae. By creating an account, ticking the acceptance box, or using the app, you agree to these terms and to our Privacy Policy. If you do not agree, do not use Sundae.

If you use Sundae through the Apple App Store or Google Play, the additional terms of that store also apply to your download and any purchases.

3. Eligibility

• You must be at least 18 years old and legally able to enter into a contract.
• You may hold one account only, for yourself, as a natural person. Sundae is for personal, non-commercial use.
• Your registration details and profile information must be accurate and kept up to date. In particular, your photos must genuinely show you and be reasonably current.
• You must not use Sundae if you have previously been banned, or if applicable law prohibits you from using such a service.
• You must not have been convicted of a serious violent or sexual offence.

4. The service

Sundae is a dating service with a deliberately limited design:

• You complete a one-time personality test and set your preferences.
• Once per weekly cycle, Sundae introduces you to one other member selected automatically based on personality, preferences, distance and prior feedback.
• Each match runs for a limited period (around one week). Either person can end it earlier. When it ends, you may be asked for brief feedback.
• A match's photo is shown blurred at first and is revealed gradually as the conversation progresses.
• There is no browsing feed and no ability to search for or select specific people.

We do not guarantee that you will receive a match in any given week, that a match will reply, that any connection will result, or that other members' information is accurate. Matching logic, timing and features may change over time.

5. Your account

Keep your login details confidential and do not let anyone else use your account. Tell us promptly at support@sundae.pro if you suspect unauthorised use. You are responsible for activity that happens through your account, except to the extent it results from our failure.

6. Rules of conduct

When using Sundae, you must not:

• harass, threaten, defame, stalk, bully or abuse anyone, or promote hatred or discrimination;
• send sexual content to a match who has not clearly welcomed it, or any sexual content involving minors;
• impersonate another person, use someone else's photos, or create a fake or misleading profile;
• post or send content that is illegal, violent, hateful, or infringes someone's rights;
• solicit money, donations, or promote products, services, events or other platforms; use Sundae for advertising, recruiting or commercial purposes;
• ask for or share others' personal data beyond what a match chooses to share with you, or publish or forward another member's photos, messages or information outside Sundae without their consent;
• use bots, scrapers or automated methods, attempt to bypass the one-match-per-week design, reverse engineer the app, or interfere with its security or operation;
• use Sundae if you are married or in a relationship in which your partner would not consent, where this would mislead a match.

You can block a match at any time and report behaviour that breaks these rules from within the chat. Reporting a person also ends the match and blocks them.

7. Your content

You keep all rights in the photos, text and other content you add to Sundae (“your content”). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for example to blur, resize or format) and display your content, solely to operate and provide the service — including showing your profile to your match. This licence ends when you delete the content or your account, except for copies your match already received (such as messages) and backups or moderation records we are permitted to keep under the Privacy Policy.

You confirm that your content is yours to share and does not infringe anyone's rights. We may remove content that breaches these terms.

8. Safety and meeting people

We are not able to verify every member, run background checks, or supervise conversations. You are responsible for your own interactions.

To the extent permitted by law, we are not responsible for the conduct of any member, online or offline. Nothing in these terms limits liability that cannot be limited by law (see section 13).

9. Sundae+ subscription

Sundae is free to use. Sundae+ is an optional paid subscription that unlocks additional, non-matchmaking features (such as seeing a match's full profile and deeper personal insights). It does not change who you are matched with.

• Price: 2,99 € per month (price for Germany; the amount shown in your app store applies and may vary by region, taxes and store).
• Billing: purchases are processed by Apple or Google through your store account, under their terms. We do not receive your payment details.
• Renewal: the subscription renews automatically for successive one-month periods until cancelled.
• Cancellation: cancel at any time in your Apple or Google account settings, at least 24 hours before the next renewal. Access continues until the end of the paid period. Cancelling in the app's settings records your intent, but the subscription itself must be managed through the store.
• Withdrawal (EU/EEA consumers): you have a statutory 14-day right of withdrawal for the purchase of digital content. By starting to use Sundae+ immediately you ask us to begin performance during the withdrawal period and acknowledge that your right of withdrawal lapses once the service has been fully provided for that billing period. Refund requests for store purchases are handled by Apple or Google.
• If we materially reduce Sundae+ features, we will let subscribers know and, where required, offer a pro-rata refund or cancellation.

10. Moderation and suspension

To keep Sundae safe, we may review reports and, where reasonably necessary, restrict, suspend or permanently ban an account, remove content, or end a match — for example where we believe these terms have been broken, where there is a risk to other members, or where we are legally required to act. Where practical and lawful, we will give you notice and a reason, and you can object by contacting support@sundae.pro. A banned account loses access to matches and messages.

11. Ending your use of Sundae

You can stop using Sundae at any time and delete your account from Settings → Account → Delete account. You can also pause matching without deleting anything. We may terminate the agreement with you on reasonable notice, or immediately for good cause (such as a serious or repeated breach of these terms). Sections that by their nature should survive termination (including content licence carve-outs, liability, and governing law) continue to apply.

12. Availability and changes

We aim to keep Sundae available but do not promise uninterrupted or error-free operation. We may modify, suspend or discontinue features, or the whole service, for operational, legal or business reasons.

We may change these terms where there is a valid reason — for example a change in the service, in technology, or in the law. We will notify you of material changes in the app or by email at least [e.g. 30] days before they take effect. If you do not accept the change, you may terminate by deleting your account before it takes effect; continued use after that date means you accept the updated terms.

13. Liability

We are fully liable for damages caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and to the extent we have given a guarantee.

For slight negligence, we are only liable where we breach a material contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely). In that case our liability is limited to the foreseeable damage typical for this type of contract.

Any further liability is excluded. This does not shift the burden of proof to your disadvantage. The same limitations apply to our personal liability where claims are made against our staff, representatives or agents.

In particular, and within the limits above, we are not liable for the accuracy of member information, for whether you receive or connect with a match, or for the conduct of other members.

14. Our intellectual property

The Sundae name, logo, app, website, design and underlying software are protected and remain our property or that of our licensors. We grant you a limited, personal, non-transferable, revocable right to use the app as intended for the duration of your account. No other rights are granted.

15. Governing law and disputes

These terms and any dispute arising from them are governed by the law of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).

16. Final provisions

If any provision of these terms is or becomes invalid, the remaining provisions stay in force. You may not assign your rights under these terms without our consent; we may assign the agreement to a successor that takes over the operation of Sundae, without reducing your rights. These terms and the Privacy Policy are the entire agreement between you and us regarding Sundae.
